Dear Animal Advocates,

We need your help! Last week, the U.S. Department of Agriculture (USDA) released a proposed rule to close a loophole in current law that has “threatened the health and humane treatment of pets sold sight unseen over the Internet and via phone- and mail-based businesses.” Please act now to make sure this important rule is implemented.

Currently, only breeders who sell dogs to pet stores or to puppy brokers are required to be licensed and inspected by the USDA. Due to the wording of the federal Animal Welfare Act—passed 40 years ago, before existence of the Internet—a large (and growing) population of commercial breeders has been able to escape federal licensing and regulation.

What this means is that in many cases, no one is checking up on breeders who sell puppies directly to consumers over the Internet. As the ASPCA has seen firsthand, the photos of happy, healthy puppies posted on a breeder’s website often grossly misrepresent what conditions are really like for these puppies and their parents.

ASPCA experts have reviewed the USDA’s proposed rule—we support it, and have a few suggestions regarding how it could be made stronger. Please help us ensure that the Internet-breeder licensing loophole is closed!

What You Can Do

The USDA is accepting comments from the public on this issue for a short time. While we were protesting, D.S. and his employees closed the store and left -- 3 hours early! On a Saturday! He has also taken his store hours off of the door.

LA City Council Moves Forward On Banning Pet Sales

LOS ANGELES (CBS) — The L.A. City Council voted Tuesday in favor of banning stores from selling dogs, cats and rabbits that are not rescues in an effort to curb the city’s animal euthanasia rates.

Eleven members of the council approved the motion, which will be drafted by the City Attorney’s Office into an ordinance banning pet sales. Councilman Bill Rosendahl cast the dissenting vote.

Councilman Paul Koretz, who sponsored the motion, said the ban would help eliminate puppy mills and reduce the city’s animal euthanasia rates.

“Puppy mills are a very cruel practice with inhumane conditions that often result in the animals having many kinds of medical problems,” Koretz said.



The approved motion also directed the Animal Services Department to report back on how the proposed ban, if enacted, would affect kill rates at city shelters and its economic effect on pet stores. Koretz’s motion also asks the department to craft a way to distinguish pet shops that comply by selling rescue dogs, cats and rabbits from stores that sell other live animals like fish and reptiles.

The ban on pet sales would go into effect six months after the ordinance is enacted and would be for a temporary three-year trial period.

Pet store owners under investigation for animal abuse

OCEANSIDE — At least one bird had to be put to sleep after investigators confiscated more than 50 puppies and dozens of other animals March 27 from the owner of three pet stores for possible mistreatment of the animals for sale.Warrants were obtained to search conditions at Naedeen’s Puppies at 1021 S. Coast Highway in Oceanside; Puppy Stars at 6167 Balboa Ave. in San Diego; Pet Place at 6512 El Cajon Blvd. in San Diego; and the owner’s private residence. The animals were primarily seized from the private home and one of the pet stores, according to law enforcement for the humane society.


Authorities took away 57 puppies and other animals such as birds, rabbits, a large tortoise, and a 7-foot python snake.

“So far one animal was euthanized, a dove, due to the condition it was in,” said Kelli Herwehe, spokeswoman for the San Diego Humane Society and SPCA.
“Some were obviously dehydrated and malnourished,” she said.
Several of the seized animals have been medically treated and required surgeries, and all of them received full veterinary exams, according to Randall Lawrence, director of Humane Law Enforcement for the humane society.

He said the animals are being housed at the San Diego Humane Society as potential evidence for the pending investigation.

“Potential charges include California Health and Safety Code violations and potential animal cruelty and neglect,” he said.

The condition of the animals along with evidence collected from the public will help determine the extent of possible charges that the owner of the pet shops may face.

The name of the owner is being withheld due to the pending investigation, Lawrence said.

“We are asking the community to provide additional support for this case,” he said.

If someone purchased an animal from any of the three above named stores, and that animal was ill at the time of purchase or later became ill, Lawrence said the humane society would like them to report the animal’s situation at (619) 243-3466.

For Janice Hatch, the day that the animals were confiscated from Pet Place was one that she won’t likely soon forget. “I stood there and cried when they brought them out,” she said.

Hatch is co-founder of the San Diego Animal Defense Team, a grassroots organization in its fourth year of protesting against pet stores that sell puppies.

The Animal Defense Team filed complaints to the county against Naedeen’s Puppies, Pet Place and Puppy Stars and said the businesses were receiving their puppies from puppy mills.

Hatch said more than 200 volunteers have helped protest. “We protested 20 times at these three stores,” she said.

The website for the Animal Defense Team lists at least six other countywide pet stores that have been targets of protest and have been asked to stop selling puppies.

“We have been contacting pet stores and asking them to sign a pledge to not sell puppies in their pet stores,” she said.

Some of those stores have closed as a result or the owners have signed the pledge and agreed to stop selling the animals, she said.

The Animal Defense Team’s protests involved the typical sign-holding cluster of people and grew to include cheerleading chants and street theater acts where protestors donned costumes.

She said the team has photos of sick puppies from the Oceanside pet store where litters of puppies were kept in children’s swimming pools.

Hatch said that storeowner didn’t respond to a letter that explained the protests.

She said although it’s not illegal to receive puppies from a puppy mill, these stores were telling customers that the puppies came from local family breeders. However, she said she obtained some breeder reports that showed the stores used a broker from out of state. “What makes it in my mind illegal is they’re telling customers they’re not doing it,” Hatch said.

The Coast News attempted to contact all three businesses, and the person who answered the number listed for Puppy Stars said it was the wrong phone number, the number for Pet Place was disconnected and there was no answer or recording at the number for Naedeen’s Puppies.

There are an estimated 10,000 puppy mills in the United States, and many consumers are unaware that they may have purchased a puppy mill puppy. The Humane Society of the United States claims that most puppy mill dogs live in shockingly poor conditions.
They have an ongoing campaign to put an end to puppy mills.

Puppy mills have hundreds, even thousands of dogs used purely for breeding that live in cages without human interactions, toys or proper care.

Many times the dogs are scared, have eye and ear problems and problems with their paw pads due to spending their life in wire cages, according to a video online with Melanie Kahn of the Humane Society of the United States. Contaminated food and algae-filled water are also woeful conditions commonly found at puppy mills.

Hatch said that she decided to help fight against puppy mills after her family rescued a puppy mill breeder dog who had half-an-ear, no teeth and a sliced tongue when they received her. Upon grooming their rescued dog, Bella, a Saint Bernard, they also found enormous cesarean scars on her belly, she said.

For the recently seized local animals, Herwehe said they won’t be released for adoption until the investigation is complete. Meanwhile, however, the San Diego Humane Society is accepting donations to help care for the animals.

Herwehe said that new enclosures need to be purchased, especially with the unique types of animals, including reptiles, that the society received after the March 27 pet store raid.

Channel 10 updated news

SAN DIEGO -- The owner of pet stores in Clairemont, Rolando and Oceanside was under investigation Wednesday for possibly mistreating animals for sale.

Investigators seized more than 100 animals Tuesday said Kelli Herwehe, a spokeswoman for the San Diego Humane Society.

A home in El Cajon also was searched as part of the operation
Among the confiscated animals were nearly 60 puppies, rabbits, a 35-pound turtle and a 7-foot python.

"These animals have been transported (and) received full veterinary exams, and several have received medical treatment and surgery," said Randall Lawrence, law enforcement director for the San Diego Humane Society. "All of the animals are now being housed ... as potential evidence for the pending investigation." None of the impounded pets were available for immediate adoption, as the investigation could be ongoing for months, Herwehe said.

Charges that potentially could result from the investigation include animal cruelty and neglect, as well as violations of state health-and-safety codes, according to Lawrence

"Any possible charges that may be pressed against the owner of these pet stores will be determined based on the evidence we collect from the public, along with the condition of the animals," he said.

A grassroots group that calls itself the San Diego Animal Defense Team has been protesting the stores since last August and filed complaints with the county, calling the businesses "puppy mills."

All stores are owned by the same owners and all have been the target of a constant campaign with protests and investigations by the Animal Defense Team. Here are photos taken during the raids. Some looking to make a quick buck are willing to go so far as to adopt a dog in need and sell it to the highest online bidder.

Animal experts are calling the concept "dog-flipping" and say the cruel practice of adopting a free pup only to turn around and sell it is on the rise, WMC reports.

These "dog-flippers" are posing as feasible adopters, but then go on to just pack them in at home with the other pooches they're looking to sell. "There are some predatory people out there who will take your dog in, say they are going to give it a good home," animal rescuer Sarah Clinton told WMC, "and then turn around and sell that dog for $50, $60, a couple of hundred dollars."

But activists and pet owners are catching on to the trend and are working to put a stop to it.

Though Amy Cannon couldn't afford her dog's litter of nine puppies, she spent hundreds of dollars to have them vaccinated and she extensively screened the potential adopters she met on Craigslist and Facebook, according to HLN.

But when the Ohio woman saw that one of the puppies she gave away was posted for sale on Craigslist for $60, she was horrified and immediately rescued him.

Cannon hopes to protect other dogs from similar fates with her Facebook awareness page -- Citizens Against Flipping Dogs, according to WMC.
"I don't think a lot of people in this country have even heard about something like this," Cannon told HLN. "It's one of those hush-hush things."

Facebook Rejects Puppy Mill Ads for Good!

In response to concerns raised by the ASPCA and its national “No Pet Store Puppies” campaign, measures will be put in place to ensure that puppy mill dogs will no longer be sold via Marketplace on Facebook. The ASPCA is working with Facebook and Oodle, the online classifieds service that powers Marketplace on Facebook, to restrict listings of puppy mill dogs on the popular social media site. Through an ongoing removal process, ads placed by puppy mills have already started coming down. The process was designed to ensure that individuals may continue to post dogs available for a nominal adoption or rehoming fee.

The ASPCA believes that reducing Internet venues through which puppy mills can offer their dogs will help combat the inhumane puppy mill industry. Many puppies sold online come from puppy mills—these are large-scale, commercial facilities that commonly keep dogs in unsanitary, overcrowded and often cruel conditions without sufficient veterinary care, food, water or socialization.

"Removing an online platform for the cruel puppy mill industry sets a positive example of corporate citizenship and will help improve the lives of countless dogs," says ASPCA President and CEO Ed Sayres. "Most consumers are unaware they are perpetuating animal cruelty by purchasing a puppy online, and given the visibility of Marketplace on Facebook, this move has the potential to raise critical awareness about unscrupulous online breeders.”

Puppy mills that sell directly to consumers over the Internet are exempt from any federal oversight, allowing unregulated breeders to sell tens of thousands of puppies a year via online transactions. The Internet Crime Complaint Center notes that hundreds of complaints are filed every year from victims who are scammed when buying a dog online.

“Consumers who purchase a puppy from a website run the risk of acquiring an unhealthy animal and often end up with expensive vet bills and broken hearts,” said Cori Menkin, Senior Director of the ASPCA Puppy Mills Campaign. “We hope additional online retailers and classifieds listings will follow this example and stop providing a platform for puppy mill sales.”

We would like to register our dismay and real concern about your partnership with Puppy Stars and Pet Place. We have documentation that they are selling puppy mill pups from out-of-state, purchased through Lambriar, Inc. in Kansas. Someone from your office was in Pet Place recently, briefly examining puppies and passed a Beagle puppy as healthy when it quite obviously had a seriously extended stomach. Pet Place has been sued three times and lost --all the cases were for selling sick dogs. People are now contacting us consistently with similar stories of purchasing sick dogs.

On Friday evening, March 16, members of the ADT saw lights on in the store. Blinds were closed but through the door they saw DOGS IN THE CAGES. They reported that the dogs were not puppies.
There were many open cages but the ones with dogs in them had about 4 dogs each and were very crowded. Three people were inside the store. One said through the closed door that they were closed to "regroup" but would open again in April and are "trying it with some rescues."
No reputable rescue would ever partner with a Pet Store.

On Saturday, March 17, the store windows and door were completely covered with newspapers so it is impossible to see what is happening inside. (See photos above.)  The sign reads "We will be open at the beginning of April. We will also have some rescue dogs available. 760-458-5778 Thanks Puppy Stars"
WHAT ARE THEY HIDING?  If the dogs in the store at 8 PM last night are still in there, they are alone and completely in the dark due to the covered windows. There are no other windows in the facility. Is this unit now being used as a temporary storage place for the dogs? Where are the puppies from both this location and Naedeen's Puppies in Oceanside? Where are they being held? We will continue to monitor and report on this alarming situation.

BREAKING NEWS! BREAKING NEWS! BREAKING NEWS!

Saturday, March 10:  Members of the San Diego Animal Defense Team (ADT) found the Puppy Stars store on Balboa Ave. in Clairemont to be empty.

Where are the puppies!
Where are the employees!
Where are the customers!

Cages were completely cleaned out -- empty of both puppies and bedding.  No water bottles on the cages. The mailbox was full and overflowing. Doors were locked. Blinds were pulled.

After a bit of cautious celebration and finding out from other tenants that although the sign said back at 1:15, the store had actually been closed for three days,
we went to their sister store on El Cajon Blvd. in Rolando: Pet Place

Pet Place was open and the veterinarian who is in a business partnership with the store
(Pet Hospital of North Park) -- in spite of ongoing warnings from all animal welfare groups such as HSUS and ASPCA  to NOT partner with puppy mill stores -- was giving the pups a rudimentary once-over. At the same time, the employee was telling a customer that they got a shipment of 6 puppies just the day before and 3 of them had already died. Here's a photo of a puppy who passed inspection. We see a distended stomach indicating a problem, possibly worms. What do YOU see?



SD Animal Defense Team investigators have already compiled a significant amount of evidence against Puppy Stars and Pet Place --
lawsuits with judgments against them
for selling sick puppies, 
proof that they use Lambriar Inc.,a notorious puppy mill factory from Kansas as their broker, 
proof they sell pups from several large "cash crop" breeders in the Midwest.
Sunday, March 11: The SD Animal Defense Team we visited their third facility in Oceanside on S. Coast Highway. It too was CLOSED! No puppies! No employees! No customers. Just empty rooms and a mountain of trash piled outside the back door:

It may be a bit too soon to celebrate. We still have work to do at Pet Place.
Our next protest is scheduled for Friday evening, March 23, 5 - 7 PM.

March Protests Added to Calendar!

We continue to push ahead for a ban on the sale of puppies in pet stores! The inhumane and unethical business of farming dogs as livestock must be stopped. In order for the commercial kennels to meet their objective of maximizing profits, the dogs need to suffer. Breeding facilities are often shockingly substandard and even when they meet legal USDA guidelines, the dogs only need to be given enough food and water to keep them alive.

The owners of Puppy Star's have seized the retail puppy store market in San Diego. Since they opened in August, 2011, the San Diego Animal Defense Team has been there, alerting the public to the cruelty of this business. They have tried many ploys to stop us -- yet we are still here! Strong and determined!

The case against Puppy Star's and their employee has not yet been set by the court. As soon as we have the date, you all will be the first to know!!! Justice moves slowly but IT WILL COME!

We urge anyone reading this who has purchased a sick puppy from Puppy Star's, Pet Place or Naedeen's Pups in Oceanside to contact us immediately. We have a good-sized list of innocent consumers who purchased either sick and/or dying puppies from these stores. We do understand that you may love these puppies very much in spite of the problems. Rescued Dogs Are the REAL Stars!

On Sunday February 19 and Sunday, February 26, members of the Animal Defense Team showed up in force -- most accompanied by their wonderful rescue dogs. They lined Balboa Ave. in front of the Puppy Star's store to show San Diego that the real puppy stars are the beautiful rescued dogs in the shelters and rescue groups.
We had all breeds, all ages, and plenty of great mixes too. Thanks for the outpouring of support, everyone! It was a heartwarming show of
